Zip Pod – Aftermarket Product Disclaimer, Assumption of Risk & Indemnification

The Zip Pod is an aftermarket accessory designed and sold by E3 Designs. It is not manufactured, approved, sponsored, or endorsed by any e-foil, motor, mast, or foil system manufacturer. The Zip Pod is intended for use only by individuals who understand and accept the risks associated with powered water sports and aftermarket equipment.

Assumption of Risk / High-Risk Activity Acknowledgment

Use of electric hydrofoils and powered watercraft involves inherent and significant risks, including but not limited to serious personal injury, equipment damage, loss of control, drowning, collision, and property damage. By purchasing, installing, or using the Zip Pod, the customer knowingly and voluntarily accepts all risks, whether foreseeable or unforeseeable, associated with its use.

The customer acknowledges that improper installation, misuse, modification, environmental conditions, rider ability, or component incompatibility may result in injury or damage.

No Warranty / Limitation of Liability

E3 Designs makes no warranties or guarantees, express or implied, regarding the Zip Pod, including but not limited to merchantability, fitness for an unintended purpose, or durability against abuse. Use of the Zip Pod may void existing manufacturer warranties, and E3 Designs bears no responsibility for such consequences.

To the fullest extent permitted by law, E3 Designs shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to personal injury, death, loss of equipment, loss of use, loss of performance, or economic loss arising from the use or inability to use the Zip Pod, whether used alone or in combination with other products.

Indemnification

By purchasing or using the Zip Pod, the customer agrees to defend, indemnify, and hold harmless E3 Designs, its owners, officers, and affiliates from and against any and all claims, demands, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to: Installation, use, misuse, or modification of the Zip Pod, Failure to follow instructions or safety precautions, Injury to any person or damage to any property, Use of the Zip Pod with third-party or modified equipment

User Responsibility:

The customer is solely responsible for: Verifying compatibility with their equipment, Proper installation and ongoing inspection, Safe operation and adherence to applicable laws and safety practices.

Use of the Zip Pod constitutes acceptance of this disclaimer, assumption of risk, and indemnification agreement.
